Biography

Howard Eilen is a founding member of Lehman & Eilen and has more than 40 years of practical and legal experience in the commodities and securities industry, initially as a broker and exchange member, then as house counsel for a commodities brokerage firm and as an attorney in private practice. He now spends substantially all of his time mediating cases.

Howard has prosecuted and defended claims (in court and in arbitration) instituted against brokers arising under the federal securities and commodities laws, as well as the Racketeer Influenced and Corrupt Organizations Act (RICO). For over 40 years, Howard has chaired dozens of arbitration panels before the National Association of Securities Dealers (now FINRA), the National Futures Association and American Arbitration Association. Howard has represented firms and individuals in enforcement proceedings and investigations conducted by the Securities and Exchange Commission, Commodity Futures Trading Commission, New York Stock Exchange, FINRA and state regulators.

Howard has successfully mediated over 2,500 cases and claims involving a multitude of diverse customer and employment claims filed against both national and regional brokerage firms involving:

Howard also mediates court initiated commercial cases in the state and federal courts involving shareholder, corporate, partnership, and limited liability company disagreements and dissolutions, breach of contract, professional liability, unfair competition, covenants not to compete, and employment and workplace issues.

In addition, Howard has been voted by his peers as one of the top 500 leading public and private judges in America, as noted in this article. His biography also currently appears in Who's Who in American Law.

Howard also has been appointed as a mediator and arbitrator by the securities commissioners of the States of Massachusetts and New Hampshire with respect to customer class claims pursuant to consent orders, as well as a Special Master in the New York State Court System, where he supervised discovery in a major securities fraud class action matter, and ultimately mediated a global settlement. 

In addition, Howard has received appointments by the U.S. Bankruptcy Court to mediate complex securities and futures litigation.
